Startup India Self-Certification: The Labour-Law Shortcut You're Not Using

DPIIT-recognised startups can self-certify compliance under specified labour and environmental laws — cutting inspections and paperwork. Here's what it covers, how it works, and the catch.

DPIIT-recognised startups can self-certify compliance under a set of specified labour and environmental laws — replacing routine inspections with a self-declaration for an initial period. It's one of the most practical benefits of recognition and one founders most often forget to use. Here's what it covers, how to opt in, and the catch: self-certifying isn't the same as being exempt.

What self-certification actually gives you

Under the Startup India scheme, recognised startups can self-declare compliance with several labour laws (and certain environmental laws), which means no routine inspection under those laws for an initial window unless there's a credible complaint. The point is to spare early teams the inspection-and-paperwork burden of laws written for large factories, while you're still small.

The specified labour laws typically include the major central ones — covering provident fund, ESI, gratuity, contract labour, and similar — though the exact list and the eligibility window are set by the scheme and change by notification, so confirm the current set.

How to use it

  1. Be DPIIT-recognised (the prerequisite — see the compliance side of DPIIT recognition).
  2. Opt in / file the self-declaration through the Startup India / Shram Suvidha route for the covered laws.
  3. Keep the declaration as evidence — like any compliance artifact, you want to be able to produce it.

The catch: self-certify ≠ exempt

This is the part that trips founders up. Self-certification changes the inspection regime, not the underlying obligation. You still have to actually comply — deposit PF and ESI on time, maintain what the law requires — you're simply trusted to self-declare it rather than being routinely inspected. So the deadlines in our PF & ESI guide still apply. Treating self-certification as "we don't have to do this" is the mistake; it's "we don't get inspected for this, as long as we're genuinely compliant."

Why it still matters for diligence

Self-certification reduces friction now, but in diligence an investor still checks that the underlying labour compliance is real (PF/ESI deposited, registrations done). The self-declaration is a benefit; the actual compliance is what the lawyer verifies. Use the shortcut, but keep the substance clean.

Track the substance, claim the shortcut

ComplianceStack keeps your actual PF/ESI and labour obligations on a calendar with evidence, and tracks the DPIIT self-certification as a standing item — so you get the inspection relief and stay genuinely compliant underneath it.
